1. ITEM PHOTOS,
DESCRIPTIONS & CONDITION CODES
. We use every effort to accurately
describe, represent and depict the items we sell. This typically includes obtaining
and sharing photographs of the item, obtaining information from the products
data plate or other written information and developing and sharing written
descriptions of the item. Additionally, if feasible, it includes sharing
information that we may have been able to obtain regarding the item’s use and
maintenance history. Finally, it includes classifying each item pursuant to a
condition code.
OUR CONDITION CODES
ARE AS FOLLOWS:
A. NSOP-NEW SURPLUS
ORIGNAL PACKAGING
. These are items that, to the best of our knowledge and
belief, have never been used and that are still in the original packaging. This
item could be several years old and may not be the most recent model, but it
has never been placed in service. The packaging may show signs of wear or be out
of date. The packaging for these items may also have writings, decals, stickers
or other markings on them. The packaging may have been opened for inspection
purposes. If you purchase an item that’s condition is designated as
“NSOP” and it does not work, we will provide a full refund or
replacement pursuant to the terms of our Hassle-Free Return Policy.
B. NSREM-NEW SURPLUS
REMOVED FROM ORIGINAL PACKAGING
. These are items that, to the best of our
knowledge and belief, have never been used but that have been removed from the
original packaging. These items may have cosmetic blemishes such as, but not
necessarily limited to, scratches, stains, minor dents, dings or other
blemishes, but have never been put into service. These items could be several
years old but have never been used. Examples of such items might include unused
circuit breakers that were stored on a shelf in a company stock room. If you
purchase an item where we designate the condition as “NSREM” and you
find the item unsuitable, we will provide a full refund or replacement pursuant
to the terms of our Hassle-Free Return Policy.
C. RE-REBUILT OR
REFURBISHED
. These are used items that have been rebuilt or refurbished by
a third party prior to our acquisition and that have not been used since being
rebuilt or refurbished. To our knowledge and belief these items are in full
working order but we have not tested them and cannot guarantee that they work.
If you purchase an item where we designate the condition as “RE” and
you find the item unsuitable, we will provide a full refund or replacement
pursuant to the terms of our Hassle-Free Return Policy.
D. USTOG-USED TAKE
OUT-GUARANTEED.
These are used items that have been taken out of service.
Items bearing this designation were known or assumed to be working immediately
prior to being taken out of service. Items in this category may have been
removed from an industrial facility as part of a plant liquidation or line
shutdown or prior to the renovation or demolition of the facility where the
item was located. If you purchase and item where we designate the condition as
“USTOG” and you find the item to be unsuitable, we will provide a
full refund or replacement pursuant to the terms of our Hassle-Free Return
Policy.
E. UAI- USED AS IS.
These are used items that have been taken out of service. Although the item
could be working, we have not tested the item and do not have enough
information to know or assume that the item was working immediately prior to
being taken out of service. Items in this category may have been removed from
an industrial facility as part of a plant liquidation or line shutdown or prior
to the renovation or demolition of the facility where the item was located or
could be used items that were stored in a company stockroom. If you purchase an
item where the condition is designated as “UAI” the item is not
subject to our Hassle-Free Return Policy, it is not guaranteed and all sales
are final.
F. FPO- FOR PARTS
ONLY.
These are items that are known to be incomplete, not working or where
a cursory inspection may show evidence of significant damage or deterioration.
If you purchase and item where the condition is designated as “FPO”
the item is not subject to our Hassle-Free Return Policy, it is not guaranteed
and all sales are final.
If you need additional photos or other information, please
ask. We want you to be satisfied and be a long term customer, so we are always
willing to take additional photos or gather additional information to help you
make the most informed purchase decision possible.
2. HASSLE-FREE RETURN
POLICY.
We offer a 30- day return period on all items
except
those that are advertised as “UAI AS IS”
(USED AS IS) or “FPO” (FOR PARTS ONLY), or where the listing details
specifically indicate that the item is not guaranteed. If, after your
inspection, you find any covered item unsuitable, at our discretion, we will
either provide you with a full refund of your purchase price or replace the
item with a comparable item at no additional costs. All requests for refunds
must be made in writing via the EBay messaging system and be made within
fourteen calendar days of the date of payment. All items must be returned in
the same condition that they were received in. Buyer agrees to pay the return
shipping. The refund will typically be made within two to three business days
after we receive the return. All returns are subject to the Inspection and
Acceptance of Product section and other applicable provisions of these
Terms& Conditions. Buyer’s failure to pick up an item within the period of
our Hassle-Free Return Policy shall not serve to extend the period for return
and refund.
3. EBAY MONEY BACK
GUARANTEE
. In addition to the benefits offered by our Hassle-Free Return
Policy, we also participate in the EBay Money Back Guarantee program which
covers you in the unlikely event that the item that you receive is different
from what is described in our listing. For more information, please see the

4. TRANSACTION &
PAYMENT
. After clicking “Buy it Now” or successfully negotiating
a Best Offer Transaction, please wait to pay until you receive an EBay invoice.
The invoice will include any applicable shipping and handling charges, taxes,
fees, etc. Upon receipt of an EBay invoice Buyer has two business days to make
payment in full, unless other arrangements have been agreed to in writing via
the EBay messaging system. Transactions that are not paid in full within two
days of the issuance of the EBay invoice will be reported to EBay and the
Seller reserves the right to cancel the transaction and to relist the item.
Payment in full is required prior to shipping.
5. METHODS OF PAYMENT
.
We accept payment via PayPal and by extension via credit cards accepted through
the PayPal program which include Visa, Master Card, American Express and
Discover.
6. RESTOCKING FEES.
At Seller’s discretion a 10% restocking fee may be charged for any returned
item.
7. WARRANTY.
Seller is a liquidator of used and surplus equipment and supplies and is not an
authorized dealer for the original manufacturer. Any reference to or use of a
particular brand or trademark is for identification purposes only and such
brands and trademarks are the property of their respective owners.
Notwithstanding the other terms and provisions contained herein, all items are
sold on an “as is” basis without warranty of any kind including any
warranties of merchantability or fitness for a particular purpose.
8. INSPECTION AND
ACCEPTANCE OF PRODUCT.
Buyer represents and warrants that he/she is
knowledgeable and experienced in the safe use, operation and maintenance of the
item and that he/she is qualified to inspect and evaluate the item to determine
its suitability for Buyer’s intended purpose. Buyer agrees to inspect all items
immediately upon receipt. Buyer agrees that if upon Buyer’s inspection, an item
is not suitable and Buyer intends to return the item then Buyer will
immediately notify Seller in writing via EBay message that such item is not
acceptable and that Buyer intends to return the item. If Buyer fails to provide
such notification to the Seller within 14 calendar days from the purchase date,
then Buyer is deemed to have accepted the item, the sale is final, and Buyer
waives any rights it may have pursuant to the terms of our Hassle-Free Return
Policy or otherwise. Buyer assumes all risks associated with the inspection,
operation, use and/or resale of the item.
9. SHIPPING &
HANDLING.
Buyer is responsible for freight charges unless the listing
details specifically indicates that the item includes “Free
shipping”. When the item listing specifies the applicable shipping and
handling charges, we will package and ship the item for the specified shipping
and handling fee price which will be automatically included in the Buyer’s EBay
invoice. For item listings where the shipping and handling charges are not
specified in the listing, please contact us via EBay message for a quote. (This
normally applies to larger items).
In the alternative, the Buyer may arrange for its own
freight or to pick up the item in person. In most instances we will package the
item and load it on the Buyer’s truck at no additional fee. However, we reserve
the right to assess palletizing, crating or packaging fees if the Buyer
arranges for freight or pick up. Please see the listing details to see if a
palletizing, crating or packaging fee may apply.
Please message us via EBay if expedited shipping is required
and we will do our best to accommodate your needs.
All items ship FOB point of origin which is Woodlawn,
Illinois 62898, United States of America unless another location is specified
in the listing.
We normally ship within one to two business days of receipt
of payment.
10. STORAGE &
DELAYED PICK UP.
For items that are not picked up within 30 days of the
date Seller receives final payment, we reserve the right to assess a reasonable
storage fee for the item and to hold the item until all the applicable storage
fees have been paid. For items that have not been picked up within 90 days of
the date Seller receives final payment, Buyer agrees that it relinquishes all
rights in the item and that Seller may retain any and all amounts previously
paid by Buyer, including but not limited to, the purchase price, as liquidated
damages and shall further have the right to dispose of or sell the item as it
deems appropriate.
11. INTERNATIONAL
SHIPMENTS.
We participate in EBay’s Global Shipping Program for qualifying
listings. For all other international transactions, Buyer is responsible for
all shipping costs, import duties, and/or customs taxes as well as any other
fees required by applicable regulatory authorities. Buyer is also responsible
for compliance with all applicable importing laws, rules and regulations for
importing to Buyer’s country from the item’s point of origin country and agrees
to pay all applicable charges.
12. CANCELLATION OF
SALE.
We reserve the right to cancel any sale. If a sale is cancelled for
any reason, other than Buyer’s failure to meet its obligations to Seller, we
will provide the Buyer with a full refund.
13. LIMITATION OF LIABILITY. Notwithstanding any warranty,
guarantee or other provision contained herein or in any listing or transaction,
in no event will Seller be liable for any indirect, special, incidental,
exemplary or consequential damages of any kind sustained from any cause or
based upon any legal theory whether via contract, tort, negligence, strict tort
liability, statutory or otherwise arising out of any sale or offering by Seller.
In no event shall Seller be liable to Buyer in an amount exceeding the purchase
price of the item. These limitations of liability include any liability that
may arise out of third-party claims and Buyer hereby warrants that it maintains
insurance to cover against such claims of third-parties. Any dispute or cause
of action relating to items purchased hereunder shall have venue, if in state
court, in Jefferson County, Illinois or, if in federal courts, in the U.S.
District Court for the Southern District of Illinois.
14. AVAILABILITY
& PRIOR SALE.
All items are offered subject to availability and prior
sale. In the event you make payment for an item that is no longer available we
will notify you as soon as possible and make a full refund of your purchase
price.
